Terms of service

1. Who we are

The wellensteyn-canada.com website (the "Site") is operated by Welligo Inc., 16 Industrial Parkway S, Unit 316, Aurora, Ontario L4G 0R4, Canada (Business Number 789641354). Contact: service@wellensteyn-canada.com, 289-990-8681. These Terms of Service, together with our Privacy Policy, Shipping Policy and Return and Refund Policy, govern your use of the Site and every purchase you make on it. By using the Site or placing an order you agree to these terms.

2. Orders and contract

When you place an order you make an offer to buy the products at the prices shown. We confirm receipt by e-mail; the contract is concluded when we send the shipping confirmation. We may decline or cancel an order — for example if a product is unavailable, a price was displayed incorrectly, or we suspect fraud — and will refund any amount already paid.

3. Prices, taxes and payment

All prices are in Canadian dollars (CAD) and exclude taxes. Applicable GST/HST/PST is calculated and shown at checkout before you confirm the order. Payment is taken at the time of ordering through our secure payment provider (Shopify Payments; major credit and debit cards, Apple Pay, Google Pay and Shop Pay). We reserve the right to correct pricing errors.

4. Shipping and delivery

Delivery is subject to our Shipping Policy. Delivery times are estimates; we are not liable for delays caused by the carrier or by events outside our control. Risk in the products passes to you on delivery.

5. Returns and refunds

Returns, exchanges and refunds are governed by our Return and Refund Policy (30 days).

6. Products

We take reasonable care that product descriptions, colours and images are accurate; minor variations may occur, in particular in colour rendering on screens. All products are genuine Wellensteyn products.

7. Intellectual property

All content on the Site (text, images, logos, design) is owned by us or licensed to us. The Wellensteyn name and logo are trademarks of Wellensteyn International GmbH & Co. KG. You may not copy, reproduce or use any content for commercial purposes without written permission.

8. Accounts

If you create a customer account you are responsible for keeping your login details confidential and for all activity under your account.

9. Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental or consequential loss arising from your use of the Site or the products. Nothing in these terms excludes or limits any liability that cannot be excluded under applicable law, including your rights under the Ontario Consumer Protection Act, 2002.

10. Site availability

We aim to keep the Site available at all times but do not guarantee uninterrupted or error-free access, and we may change or withdraw content without notice.

11. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputes are subject to the jurisdiction of the courts of Ontario, without prejudice to your rights as a consumer to bring proceedings in your own province.

12. Changes

We may update these terms from time to time; the version in force is the one published on the Site at the time of your order.
